Etairos Health Settles Ransomware-Related Class Action Lawsuit

Etairos Health has agreed to settle class action litigation stemming from a February 20, 2024, ransomware attack and data breach that exposed the personal information of current and former employees. A ransomware group breached its network and potentially viewed or obtained employee information such as names, phone numbers, addresses, government-issued ID numbers, and Social Security numbers. The affected individuals were notified on or around March 22, 2024.

A class action lawsuit – Isabel Garcia Bueno v. Etairos Health, Inc. – was filed by plaintiff Isabel Garcia Bueno on May 14, 2024, asserting claims for negligence and breach of implied contract. The plaintiff alleged that Etairos Health should have prevented the data breach and would have been able to if appropriate cybersecurity measures had been implemented. The lawsuit is pending in the Circuit Court for the Sixth Judicial Circuit in and for Pinellas County, Florida. Etairos Health denies wrongdoing, liability, and all the claims and contentions in the lawsuit, and the plaintiff believes the claims asserted in the litigation have merit. To avoid the time, cost, and risks associated with continued litigation, all parties agreed to a settlement.

The negotiated settlement includes up to $146,500 in attorneys’ fees and expenses, a $3,500 service award for the class representative, and benefits for the class members. Class members may claim up to $4,500 as reimbursement for documented, unreimbursed losses due to the data breach, including up to eight hours of lost time at $15 per hour (max $120). Class members who chose not to submit a claim for reimbursement of losses and/or lost time may claim a one-time cash payment of $75.

The deadline for exclusion and objection is November 20, 2026. The deadline for submitting a claim is December 21, 2026. The final approval hearing has been scheduled for January 20, 2027.
